Partnership work visa changes
Conditions added to partnership-based work visas
For visa applications lodged from 31 May 2023, partners of work visa holders, who apply for a work visa on the basis of their relationship, will have certain restrictions:
- they can only work for an employer who is accredited
- they must be employed on at least $29.66 / hour (or the median wage in effect at the time they receive the job offer)
- they cannot work in roles covered by capped Sector Agreements.
- if working in a role covered by an uncapped Sector Agreement, they must be paid at least the relevant wage threshold in place. They will not be subject to a stand down period.
Are there exemptions to these restrictions?
Yes, these restrictions will not apply to partners of:
- New Zealanders
- Certain Post study work visa holders
- AEWV holders on twice median wage
- AEWV holders with a role on the Green list and meeting the Green list requirements (“suitably qualified”)
When are these changes implemented?
These changes will be in effect for visa applications submitted from 31 May 2023. Any visa application applied for, before that date, will not be impacted.
